Unrestricted Patients

If a patient is detained under an ordinary hospital order, he must not be discharged if:

a)

he is suffering from mental illness, psychopathic disorder, severe mental impairment or mental impairment; or

b)

the disorder is not of a nature or degree which makes it appropriate for him to be detained in a hospital for medical treatment; or

c)

it is not necessary for the health or safety of the patient or for the protection of other persons that he should receive such treatment.

The tribunal does not however, have to discharge patients who are deemed to be untreatable. Most important, if any one of the criteria for releasing the patient exists, he must be released whether dangerous or not.
